1. Acceptance of Terms
By using PreCheck, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use our services.
2. Services Provided
PreCheck is a platform that offers facial recognition and face search services. You agree to use our services only for lawful purposes and in accordance with all applicable laws.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account information, including your username and password. You must notify us immediately if you suspect any unauthorized use of your account.
4. User Conduct
You agree not to use our services for any illegal or unauthorized purpose, including but not limited to violating any intellectual property rights, engaging in fraudulent activities, or distributing harmful content.
5. Data Privacy
Your use of our services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using our services, you consent to the collection and use of your data as described in our Privacy Policy. This includes the use of Google Analytics for tracking and analyzing usage patterns to improve our services.
6. Intellectual Property and User-Provided Content
All content, trademarks, and data on this site, including software, text, graphics, logos, icons, and hyperlinks, are the property of Silent Co, LLC or its licensors. You are responsible for ensuring that any images or content you upload to PreCheck are legally yours to use and share within your jurisdiction. Unauthorized use is strictly prohibited.
7. Manual Review of Content
PreCheck reserves the right to manually review any images or content uploaded to our platform to ensure compliance with these Terms of Service and applicable laws. However, we are not responsible for the content uploaded by users and cannot guarantee the accuracy or legality of such content.
8. Acceptable Use Restrictions
PreCheck is provided for lawful, informational purposes only. You agree that you will not use the services, or any results obtained from them:
- To make, or as a factor in making, any decision regarding a person's eligibility for employment, credit, insurance, housing, tenancy, education, or any government benefit or license. PreCheck is not a consumer reporting agency, the services are not a consumer report or investigative consumer report as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq., and the services have not been assembled or evaluated for any such purpose.
- To stalk, harass, threaten, intimidate, defame, dox, surveil, or otherwise harm any person, or to attempt to locate or identify a person who has not consented, where doing so would violate applicable law.
- In violation of any biometric privacy, data protection, anti-discrimination, wiretapping, or anti-stalking law applicable to you or to the individual depicted.
- To upload any image you do not have the lawful right to possess, use, and submit, or any image depicting a minor.
You are solely responsible for determining whether your use of the services is lawful in your jurisdiction and for the individual whose image you submit. We may suspend or terminate access for any suspected violation of this section, without notice.
9. Disclaimer of Warranties
THE SERVICES, INCLUDING ALL RESULTS, MATCHES, SCORES, IMAGES, AND DATA, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILENT CO, LLC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
Facial recognition is probabilistic and inherently imperfect. We do not warrant that any match is correct, that any identified person is the person depicted, that results are complete, current, or error-free, or that the services will be uninterrupted or secure. A similarity score is a statistical estimate, not a determination of identity. Results may include false matches, may omit genuine matches, and may reference third-party content we do not control or verify.
10. Assumption of Risk and No Reliance
You acknowledge that results are informational only and are not a background check, identity verification, criminal-records check, or consumer report. You agree that you will not rely on the services as the sole basis for any decision about any person, and that you will independently verify any information before acting on it.
You knowingly and voluntarily assume all risks arising from your use of the services and from any action you take, or decline to take, based on results — including risks arising from an incorrect, incomplete, or misattributed match. Any decision you make based on the services is your decision alone.
11. Indemnification
You agree to indemnify, defend, and hold harmless Silent Co, LLC and its officers, directors, employees, contractors, affiliates, and service providers from and against any and all claims, demands, actions, investigations, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your use of, or inability to use, the services, or any results obtained from them;
- any image or content you upload, including any claim that you lacked the right to submit it;
- any claim brought by a third party — including a person depicted in an image you submit — relating to your submission, your use of results, or any action you took based on them;
- your breach of these Terms, including the Acceptable Use Restrictions above; or
- your violation of any law or of the rights of any person.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, at your expense, and you agree to cooperate with our defense. This obligation survives termination of your account and of these Terms.
12. Limitation of Liability
Silent Co, LLC is not liable for any damages resulting from your use of our services, including but not limited to direct, indirect, incidental, punitive, and consequential damages. We make no guarantees regarding the results obtained through our services, and you acknowledge that results may not always be accurate or meet your expectations.
13. Termination
We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users or us.
14. Governing Law
These terms and your use of PreCheck are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware.
15. Changes to Terms
We may update these Terms of Service from time to time. Your continued use of our services after any changes constitutes your acceptance of the new terms.
